Check Your State Before You Buy
Federal law permits hemp and hemp-derived CBD. The 2018 Farm Bill removed hemp from the Controlled Substances Act. Hemp is Cannabis sativa with delta-9 THC at or below 0.3% on a dry weight basis. A product above that line is not hemp under federal law.
State law adds rules on top. Some states ban CBD in food and drinks. Some states ban delta-8 THC and other intoxicating hemp cannabinoids. A few states require a state license for hemp sales. Check your state agriculture department and health department pages. Then check the seller's shipping list. A store that claims to ship to all 50 states with no state list is a risk.

- "Legal in all 50 states" appears on many listings. That claim fails for delta-8 and for any product above 0.3% THC.
- Potency labels drift. A 2023 study of online CBD products found gaps between the label and the measured content. Match the COA batch number to your bottle.
- Vape products carry added risk. CDC linked EVALI lung injuries to vitamin E acetate in THC vapes.
