Short answer

Delta gummies are legal in some US states and illegal in others. No single federal rule covers them. Hemp-derived gummies with 0.3% or less delta-9 THC by dry weight sit in a federal gap. About 24 states ban or restrict the same products. Rules change each legislative session. Check your state law before you buy.

The 2018 Farm Bill

The Agriculture Improvement Act of 2018 removed hemp from the Controlled Substances Act. Hemp means Cannabis sativa L. with a delta-9 THC concentration of 0.3% or less on a dry weight basis. The text names delta-9 THC. It does not name delta-8 THC, delta-10 THC, or HHC.

That gap built the hemp-derived market. Sellers argue that any cannabinoid from hemp is legal. Regulators disagree.

DEA position

DEA has said delta-8 THC made by chemical synthesis is a Schedule I controlled substance. Most commercial delta-8 comes from CBD isomerization, a chemical conversion. No federal court has settled the question for the whole country. DEA's 2020 interim final rule on hemp also said cannabinoids made by synthesis remain controlled.

FDA position

FDA has not approved delta-8 THC for any use. FDA states that delta-8 THC cannot be sold as a dietary supplement and cannot be added to food. The agency has sent warning letters to makers of delta-8 gummies and vapes. FDA cites adverse event reports.

Delta-9 hemp gummies

Hemp-derived delta-9 gummies fit the Farm Bill math. A gummy can hold 5 mg or 10 mg of delta-9 THC and still pass if the dry weight of the product keeps delta-9 at or under 0.3%. That is why hemp delta-9 exists. Federal law allows it. Some states cap it. Minnesota's 2023 hemp law set a limit of 5 mg per serving and 50 mg per package for adults 21 and over.

State law

State rules fall into three groups.

The count of ban states moves. As of 2025, about half of states had a ban or a heavy limit on delta-8. A list from 2023 is out of date.

Delta-8 vs delta-9 gummies

Delta-9 gummies from hemp have a clearer federal footing. Delta-8 gummies rest on an isomerization argument that regulators reject. Several states that allow delta-9 hemp products still ban delta-8.

Shipping and mail order

USPS and private carriers follow federal and state law. A product legal in the seller's state may be illegal at the delivery address. Some carriers refuse hemp THC shipments. A seller's claim of shipping to all 50 states does not override state law.

What to check before buying

  1. Your state statute on hemp-derived intoxicating cannabinoids.
  2. Total THC per serving and per package on the label.
  3. A batch lab report with cannabinoid potency, residual solvents, pesticides, and heavy metals.
  4. An age gate. 21 and over in most regulated states.
